Terms & Conditions of Sale
This document describes the terms and conditions of sales used by digital everywhere Unterhaltungselektronik GmbH for the selling of goods to private customers. These terms and conditions do not affect consumers' statutory rights as contained in current legislation governing the relationship between consumers and businesses.

1. Definitions
Along this document the following convention will be used:
"the company" refers to digital everywhere Unterhaltungselektronik GmbH, with a place of business at Maria Gailer Strasse 16, 9500 Villach, Austria.
"the Customer" or "you" refers the account applicant or the person who buys or agrees to buy goods from the company.

2. Acceptance of Orders
An order can be issued by the customers per email, on the company's web shop and any other form which the company make known and available to its customers.
No order issued from the customer shall be binding unless and until it is accepted by the company. The company at its absolute discretion may accept or reject any order for any reason whatsoever. -
3. Product Specifications
The company warrants that the goods will be at the time of delivery correspond to the description given by the company. It is the responsibility of the customer to check the compatibility and suitability of goods for any particular purpose before ordering. The company hereby reserves the right to make without notice such minor modifications in specifications, designs or materials as it may deem necessary or desirable by experience.

4. Payment
Payment of ordered goods has to be made before dispatch of goods. No goods will be shipped before payment has been verified from the company.

5. Delivery
After delivery of items, customers will be informed of an estimated delivery date.
Whilst every reasonable effort shall be made to keep to any delivery date, time of delivery shall not be of the essence and the company shall not be liable for any losses, costs, damages or expenses incurred by the customer or any other person or company arising directly or indirectly out of any failure to meet any estimated delivery date.
The standard delivery method is chosen from the company except in the case where a different courier/method has been requested from the customers in advance of the placement of the order. -
6. Warranty and Returns of defective goods
The company grants a warranty period of 12 (twelve) month from the date of the invoice on each item ordered from digital everywhere, except consumables and software.
Items resulting defective during the warranty period has to be returned to the company for repairing/replacement to company costs.Defects arising from misuse of the items or exposition to abnormal environmental condition (as for example but not limiting to: mains power transient or dropouts, extremes of vibration, temperature, humidity, chemical corrosion, electrostatic discharge, damages occurring from falling of the items) are not covered from the warranty and repairing will only be issued under payment of the repair service from the customers. In those cases the customers will always be informed of the estimated cost of the repair service and asked for a written confirmation of costs acceptance before repairing.
Before returning any defective item you must first contact the company and obtain a Product Returns Number.
Goods defective on Arrival:
If your goods are faulty on arrival, you have 14 days to inform us of the defect. When the goods are returned to us and the fault has been verified, we’ll issue either a full refund if you wish or replacement/repair of the faulty device.If no fault is found, a restocking fee of 10% of the purchase cost will be charged to you.
Goods defective in Warranty Period:
If your goods develop a fault but it’s more than 14 days since receipt, then provided your product is within its warranty period, you are entitled to a warranty replacement/repair of the faulty device.If no fault is found, a restocking fee of 10% of the purchase cost will be charged to you.

7. Place of law
Place of law for any legal matter is Austria, court of Villach.

8. Mandatory information in line with Distance Selling Regulations
The terms and conditions detailed below are provided for your information, in line with legislation contained in Distance Selling Regulations (and accordingly to the austrian law: Fernabsatzgesetz in das Konsumentenschutzgesetz (KSchG)).
This legislation covers items bought where there is no direct contact between the supplier and the consumer. It does not apply where goods are bought for business use, from showrooms, fairs or exhibitions.

Description of goods, Price, Shipping costs, Payments modality
Details of the specification, price and arrangements for payment of the goods purchased by distance selling are available on our web site. Customers may want to print out copies of web orders for their records. Customers can obtain on request any other information or detail they may need contacting the company at the above address at any time.
A printed detailed invoice and technical information on a durable support are delivered together with the ordered items.Complaints
If you have any complaints regarding the company or the delivered items, these can be addressed to the above Company Address or contact address. The company will acknowledge written complaints within 5 working days. The time to reach complete resolution of complaints depends on the nature and complexity of the complaints. The company will engage any effort to solve complaints and to keep the customers informed on the progress of actions taken to solve them.Return of goods
Distance Selling regulations allow the customer to return specified goods to the company without any reason within 7 days from receiving of items and to be refunded of the item's cost. This right excludes goods made to the consumer’s specifications, it does not apply to goods intended for everyday consumption and excludes also video recordings or computer software unsealed by the consumer. This right doesn't apply to business customers. -
9.Returns of goods in line with Distance Selling Regulations
To cancel the contract under the terms of the Direct Selling legislation, the customer must contact the company in writing or email to the above address within 7 days of receipt of the goods. The customer will be required to return the goods to the company before a refund can be processed. The company will provide to the customer a RETURN TO MANUFACTURER number within 5 working days. This number must be quoted on all returned goods so that the goods can be properly identified. The company cannot be held responsible for goods returned without proper identification.
Once you’ve obtained a RETURN TO MANUFACTURER number from the company, you have 14 days to return the items to the company at your own expense.
Goods returned have to be complete and in a re-saleable condition including original packaging, any manuals, blank warranty cards, accessories, and any other documentation included with the original shipment. Warranty and licensing seals must be in their original state.
Please note that if any loss in goods value coming from opening the original packaging or breaking any seal can be proved, the company will refund only the value of the returned goods diminished of that loss.
The refund will also be diminished of any cost arising from the transport of returned items to the company address.Refunds will be credited using the original payment method within 14 days of receipt of the returned goods at digital everywhere Unterhaltungselektronik GmbH, although please note that the refund may not appear on your statement until 30 days have elapsed.
